TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern the provision of property search services
(“Services”) by Tenet Property Searches Ltd (“Tenet”, “we”, “our”, “us”) to you (“the Client”, “you”). By placing an order with us, you agree to be bound by these Terms.
1. Services Provided
1.1. We provide property search reports and related services for residential and commercial property transactions in England and Wales.
1.2. We are committed to delivering accurate, timely, and comprehensive reports using data obtained from reliable third-party sources, including local authorities and water companies.
2. Search Code Compliance
2.1. In providing search reports and services we will comply with the Search Code
2.2. Compliance with the Search Code ensures that clients receive products and services of the highest standard, with consumer protection and access to an independent complaints procedure if needed.
3. Dispute Resolution and TPO Contact Details
3.1. In line with the Alternative Dispute Resolution for Consumer Disputes (Amendment) Regulations 2015, the following contact details are provided for TPO:

3.2. We aim to resolve any complaints internally in a fair and timely manner. If a complaint remains unresolved, you may escalate the matter to TPO.
3.3. If you are not satisfied with our final response, or if we have not provided a final response within the timescales outlined in Tenet Property Searches’ Terms & Conditions, you may refer your complaint to The Property Ombudsman (TPO). 4. Ordering and Delivery
4.1. Orders must be submitted via our approved ordering platform or by email using the details provided on our website.
4.2. Estimated delivery times are stated at the time of order and may vary depending on the complexity and availability of third-party data.
5. Fees and Payment
5.1. Fees for services are agreed upon at the time of order and are exclusive of VAT unless otherwise stated.
5.2. Payment is due within 30 days of the invoice date, unless otherwise agreed in writing.
6. Insurance Cover
6.1. Tenet maintains professional indemnity insurance through UK Global (Part of Howden), providing coverage of up to £2 million per claim.6.2. If the subject property is valued above £2 million, the client must notify Tenet at the time of ordering to allow us to arrange additional cover. Failure to notify may affect the extent of your protection.
7. Accuracy and Liability
7.1. We take reasonable care in the compilation of all search reports but rely on the accuracy of third-party information sources.
7.2. We accept no liability for any errors, omissions or delays caused by third-party data providers.
7.3. If you identify a potential error in a report, you must notify us in writing within 10 working days of becoming aware of the issue. We will investigate and, where appropriate, correct any verified errors at no additional cost.
8. Limitation of Liability
8.1. Our total liability to you for any claim arising out of or in connection with our services shall not exceed the amount recoverable under our professional indemnity insurance, currently capped at £2 million per claim.
8.2. We shall not be liable for any indirect or consequential loss, including loss of profit, business, contracts, anticipated savings, or goodwill.
9. Confidentiality and Data Protection
9.1. We treat all information provided by clients as confidential and will only use or disclose such information as required to deliver our services or as otherwise required by law.
9.2. We process all personal data in accordance with the UK GDPR and Data Protection Act 2018. Please refer to our Privacy Policy for further details.
10. Governing Law and Jurisdiction
10.1. These Terms and any disputes arising from them are governed by the laws of England and Wales.
10.2. The parties submit to the exclusive jurisdiction of the courts of England and Wales.
11. Third-Party Terms
11.1. Some of the services and data we provide may be sourced from third-party suppliers.
In using our services, you agree to comply with any applicable third-party terms and conditions.
11.2. In particular, you agree to be bound by the third-party terms set out by Elan Convey, available at the following link:

11.3. It is your responsibility to review and comply with any third-party terms where applicable. These terms may change from time to time without notice.
12. Formal Written Complaints Procedure
12.1. Tenet Property Searches is registered with the Property Codes Compliance Board as a
subscriber to the Search Code. A key commitment under the Code is that firms will handle
complaints both speedily and fairly.
12.2. If you wish to make a complaint, we will:
- Acknowledge your complaint within 5 working days of receipt.
- Normally deal with it fully and provide a final written response within 20 working days of receipt.
- Keep you informed by letter, telephone, or email (as you prefer) if we need more time.
- In any event, provide a final written response within 40 working days of receipt.
- Liaise, at your request, with anyone acting formally on your behalf.
12.3. If you are not satisfied with our final response, or if we exceed the response
timescales, you may refer your complaint to The Property Ombudsman Scheme (TPOs):

12.4. We will cooperate fully with the Ombudsman during any investigation and comply with their final decision.
